- Overview of Services
Ziqual connects customers who need custom-machined or 3D-printed parts ("Customers") with third-party machine shops ("Vendors"). We facilitate quoting, order management, and payment processing, and we charge a 15% service fee per transaction. Ziqual does not directly manufacture or sell products.
- Eligibility and Account Registration
To use our services, you must:
- Be at least 18 years old
- Create an account with accurate and complete information
- Maintain the confidentiality of your account credentials
You are responsible for all activity under your account.
- User Content
By using our services, you may upload CAD files, drawings, comments, and related content ("User Content"). You retain ownership of your content, but you grant Ziqual a non-exclusive license to use, copy, transmit, and share it with Vendors as needed to fulfill your requests.
You represent that you have the legal right to upload all content and that it does not infringe on third-party rights.
- Quoting and Orders
Quotes are provided based on the information and files you submit. Once a quote is accepted and payment is made, production may begin immediately. Order cancellations are subject to request but are not guaranteed once manufacturing has started.
- Returns and Defects
We accept returns only for parts that are demonstrably defective and do not meet the specifications you clearly communicated at the time of ordering. Any return requests must be made within 7 days of receiving the product and must include documentation of the defect.
- Shipping and Delivery
We strive to ensure timely delivery, but Ziqual is not responsible for delays or losses caused by shipping carriers. Risk of loss passes to the customer upon transfer to the carrier.
6.1 Importer of Record
For orders involving international shipment, including parts manufactured by overseas Vendors, the Customer shall be designated as the Importer of Record (IOR). As the Importer of Record, the Customer is solely responsible for:
- Compliance with all applicable import laws and regulations
- Payment of all import duties, tariffs (including Section 301 duties, if applicable), taxes, and customs clearance fees
- Providing any required import documentation
- Ensuring accurate product classification and declared values
Ziqual does not act as the Importer of Record and assumes no responsibility for customs clearance or associated liabilities. Any assistance we provide in coordinating shipment or facilitating communication with shipping or customs agents is done as a courtesy and does not alter this responsibility.
- Payments
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service and authorize us to charge your selected payment method.
- Fees
Ziqual charges a 15% service fee on each successful transaction between Customers and Vendors. This fee is included in the total quoted price.
- Intellectual Property
All content on the Ziqual website (except for User Content) including text, graphics, and logos, is the property of Ziqual or its licensors and protected under applicable intellectual property laws.
- Limitation of Liability
Ziqual provides a facilitation service and is not liable for:
- Manufacturing errors by Vendors
- Shipping delays or loss
- Indirect, incidental, or consequential damages
Our maximum liability is limited to the amount you paid for the specific order in dispute.
- Dispute Resolution
You agree to resolve any disputes with Ziqual through binding arbitration in California, under the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in class actions.
- Modifications
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting them on our website. Continued use of the service after such notice constitutes acceptance.
